1. Acceptance of Terms
Welcome to FursaFlow. By accessing or using our platform at fursaflow.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.
These Terms constitute a legally binding agreement between you and FursaFlow Ltd ("we," "us," or "our"), a company registered in England & Wales, based in London, United Kingdom.
1.3 Definitions
In these Terms, the following definitions apply:
- "Platform" means fursaflow.com and all associated applications, services, and features operated by FursaFlow Ltd.
- "Learner" means a registered individual user who browses, applies for, and participates in project challenges listed on the Platform for the purpose of developing and demonstrating skills.
- "Company" means a registered business, organisation, or sole trader that lists project challenges on the Platform for Learners to take on.
- "Mentor" means a registered independent practitioner who lists and delivers mentorship packages to Learners via the Platform.
- "Project Challenge" means a scoped, time-limited work challenge posted by a Company on the Platform, designed to give Learners genuine applied experience.
2. Eligibility
To use FursaFlow, you must:
- Be at least 18 years old
- Have the legal capacity to enter into binding contracts in your jurisdiction
- Not be prohibited from using the Platform under applicable law
- Provide accurate and complete registration information
- Not have been previously banned from the Platform
By creating an account, you represent and warrant that you meet all eligibility requirements. We may terminate accounts found to belong to persons under 18 without notice.
3. Platform Intermediary Statement
FursaFlow is a technology marketplace intermediary only. FursaFlow does not employ Learners, act as a staffing agency, recruitment agency, or employment business, provide training services, supervise or direct any work performed by Learners, or guarantee any outcome for any party.
Any arrangement entered into between a Learner and a Company or between a Learner and a Mentor is a direct, independent agreement between those parties. FursaFlow is not a party to any such arrangement and assumes no responsibility for the performance of those arrangements.
4. User Accounts
4.1 Account Creation
- You must provide accurate and truthful information
- One person may only hold one account
- You are responsible for maintaining account confidentiality
- You must notify us immediately of any unauthorised access at support@fursaflow.com
4.2 Account Security
You agree to:
- Use a strong, unique password
- Not share your login credentials
- Log out from shared devices
- Enable two-factor authentication when available
4.3 Account Responsibility
You are responsible for all activities that occur under your account. We are not liable for losses resulting from unauthorised use of your account.
5. Company Obligations
Companies and organisations listing projects on FursaFlow agree to:
- Provide accurate and complete project descriptions
- Have the legal authority to bind their organisation to these Terms
- Comply with all applicable employment, labour, and data protection laws in the jurisdictions where they operate
- Not use projects to displace existing paid employees or fill open employment vacancies
- Ensure every project has clear learning objectives and a named point of contact for the Learner
- Pay Learners at or above the applicable minimum wage where payment is offered
- Provide constructive feedback upon project completion
- Sign a Data Processing Agreement before any Learner personal data is shared
Companies indemnify FursaFlow against any claim arising from their failure to comply with employment law or from their treatment of Learners.
6. Learner Obligations
Learners engaging with projects on FursaFlow acknowledge and agree that:
- Participation in a project does not create an employment relationship between the Learner and FursaFlow or between the Learner and the Company
- FursaFlow does not guarantee any job offer, future engagement, or employment outcome
- Compensation terms (paid or unpaid) are disclosed before the Learner applies and form part of the direct agreement between Learner and Company
- Learners must only apply to projects they have the capacity to complete
- Learners must deliver work to the agreed scope and timeline
- Learners must communicate promptly with Companies and Mentors
7. Mentor Services
Mentors offering services on FursaFlow represent that they are:
- Operating as independent contractors and not as employees of FursaFlow
- Solely responsible for setting their own rates, availability, and deliverables
- Responsible for the accuracy of their professional credentials and representations
- Responsible for maintaining the confidentiality of any information shared by Learners or Companies
Mentors indemnify FursaFlow against any claim arising from their conduct or the content of their services.
8. Unpaid Project Framework
FursaFlow actively encourages paid projects and promotes them above unpaid listings. Where unpaid projects are permitted, the following rules apply:
- Unpaid projects are capped at 30 days in duration
- Every unpaid project must have documented learning objectives
- The Company must commit to providing a named mentor or feedback contact
- Unpaid projects must not displace a paid employee or fill an open role
United Kingdom and Australia: Learners based in the United Kingdom who are not on an accredited academic placement and Learners based in Australia who are not on an approved vocational placement are directed to paid projects only, in compliance with applicable minimum wage legislation.
United States (including California): US federal law (Fair Labor Standards Act) and state laws — particularly in California — may classify unpaid work arrangements at for-profit companies as illegal employment. FursaFlow strongly recommends that US-based learners seek paid projects only. Companies engaging US-based learners on unpaid projects are solely responsible for ensuring compliance with the FLSA seven-factor primary beneficiary test and all applicable state law.
European Union: Several EU member states impose mandatory pay for work engagements at for-profit companies. In Germany, companies must pay learners the national minimum wage (currently €12.41/hr) for any engagement regardless of duration. In France, companies must pay a mandatory gratuité for engagements exceeding two months. Other EU member states may impose additional requirements. EU-based Companies are solely responsible for compliance with the national employment laws of their member state.
FursaFlow makes no representation that any unpaid project arrangement is compliant with the laws of any specific jurisdiction. Both parties are responsible for their own legal compliance.
9. Intellectual Property
9.1 Project Work Product
Work product created by a Learner in the course of a project is assigned to the Company, as specified in the project agreement between Learner and Company.
9.2 Learner Attribution
Learners retain the right to record and reference their project contribution in their FursaFlow profile and portfolio. Companies must not remove or suppress Learner attribution from delivered work.
9.3 Pre-existing IP
Learners retain ownership of any intellectual property created before or independently of the project ("Background IP"). Learners must disclose any Background IP incorporated into project submissions before project commencement.
9.4 Platform Content
FursaFlow and its content, features, and functionality are owned by FursaFlow Ltd and protected by copyright, trademark, and other intellectual property laws.
10. Acceptable Use
All users must comply with our Acceptable Use Policy, which forms part of these Terms. Violations may result in account suspension or termination.
11. Platform Fees
- Creating an account is free
- Browsing projects and profiles is free
- Service fees apply to completed paid projects (typically 10–15%), charged to the Company on project completion
- Payment processing fees may apply and are disclosed at the point of transaction
- Premium features may require additional fees, disclosed before purchase
We reserve the right to change our fees with 30 days' notice. Current pricing is available in your account settings.
12. Limitation of Liability
To the fullest extent permitted by law, FursaFlow's aggregate liability to any user shall not exceed the greater of (a) fees paid by that user to FursaFlow in the 12 months preceding the claim or (b) £100. For users who have paid no fees, our liability is capped at £100.
FursaFlow is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
The Platform is provided "as is" without warranties of any kind. We do not guarantee uninterrupted, error-free, or secure operation, nor the quality or fitness of any user, project, or work performed.
13. Indemnification
You agree to indemnify and hold harmless FursaFlow Ltd, its officers, directors, and employees from any claim, damage, or expense (including legal fees) arising from:
- Your use of the Platform in violation of these Terms
- Your content posted on the Platform
- Your conduct towards other users
- For Companies: any claim by a Learner arising from employment law non-compliance
14. Dispute Resolution
Disputes between Learners and Companies should be resolved as follows:
- Level 1 — Direct Resolution: Learner and Company communicate directly via platform messaging to resolve the issue.
- Level 2 — FursaFlow Mediation: Either party may request FursaFlow mediation by contacting support@fursaflow.com. FursaFlow will provide a non-binding recommendation within 7 days.
- Level 3 — External Arbitration: For disputes exceeding £500, either party may refer the matter to a mutually agreed arbitration body. FursaFlow is not a party to such arbitration.
15. Termination
15.1 By You
You may close your account at any time from account settings. Termination does not relieve you of obligations for active projects or outstanding fees.
15.2 By Us
We may suspend or terminate your account if you:
- Violate these Terms or the Acceptable Use Policy
- Engage in fraudulent or harmful activity
- Fail to pay fees owed
15.3 Effect of Termination
Upon termination, your access ceases, your profile is deactivated, and outstanding payments remain due. Sections 9, 12, 13, and 16 survive termination.
16. Governing Law
These Terms are governed by the laws of England and Wales. Any dispute not resolved through the process in Section 14 shall be subject to the exclusive jurisdiction of the courts of England and Wales.
17. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified to registered users with at least 30 days' notice. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
